Ucha Nanuashvili appreciates the decision made by the Constitutional Court.

"The state is obliged to comply with the terms of the state authorities by the separation of competencies and functions, without duplication, in a timely and effective manner. The state has a duty to provide a coordinated action,all of its bodies so that individual"s constitutional right be protected.
Constitutional Court"s decision of 16 September 2015, serves to protect a person from deliberate infringement and strengthen the protection of liberty . For this purpose, the Court recognized as unconstitutional the law"s provision, which certainly can not exclude the possibility of arbitrary actions by government entities.

The Constitutional Court"s decision of 16 September 2015 is not of self-executing nature , since it only refers to the legal basis, the specific facts of the case should be assessed by the court as it happened in the case of Giorgi Ugulava.
The City Court"s decision of 17 September 2015, , to cancel the detention of Giorgi Ugulava on the basis of the Constitutional Court"s decision is a correct legal form, by which the state restored person"s liberty and the rule of law by the separation of competences, "- reads the statement released by the Public Defender`s office.
